K. METZLER CALLED A REGULARLY SCHEDULED MEETING OF THE WILLINGTON INLAND WETLANDS AND WATERCOURSES COMMISSION TO ORDER AT 7:35 P.M. JULY 9, 2001 AT THE TOWN OFFICE BUILDING, 40 OLD FARMS ROAD, WILLINGTON.

The commission agreed to change the agenda order to accommodate public speakers.

1.     File #W2001-43-Application for a wetlands permit to install a septic system in the regulated area located at 122 Moosemeadow Road (Map 26, Lot 11). Lesley and Steven Sweeney owners/applicants. (Received on 07/09/01, no decision before 07/23/01, hearing or decision by 09/10/01).

Ms. Sweeney explained to the commission that presently, her property has no septic system.

The commission reviewed the file.


G. BLESSING MOVED TO REMAND TO STAFF FILE #W2001-43-APPLICATION FOR A WETLANDS PERMIT TO INSTALL A SEPTIC SYSTEM IN THE REGULATED AREA LOCATED AT 122 MOOSEMEADOW ROAD (MAP 26, LOT 11). LESLEY AND STEVEN SWEENEY OWNERS/APPLICANTS. (RECEIVED ON 07/09/01, NO DECISION BEFORE 07/23/01, HEARING OR DECISION BY 09/10/01).

2.     File #W2001-39-Application for a wetlands permit to install a Firewater Pond with a dry hydrant located on the east side of Battye Road & north of South Willington Brook crossing Battye Road. Joseph Vobril owner/applicant. (Received on 06/25/01, no decision before 07/09/01, hearing or decision by 07/23/01).

J. Vobril reviewed his plans for the site.

S. Yorgensen asked about the dam area.

J. Vobril said it is about 10 feet away. It was an excavated structure.

T. Gutowski asked if this was a request from the fire department.

S. Yorgensen said No.

T. Gutowski asked Mr. Vobril why he wanted this done.

J. Vobril said there are many properties in the proximity and it will be beneficial form an insurance standpoint. They will be able to store about 300,000 gallons, and property insurance will go down.

T. Gutowski asked about the character of the brook.

J. Vobril said it is an intermittent stream.

J. Csiki asked if a specific pipe was for catching runoff.

J. Vobril said Yes, and reviewed the plan.

G. Blessing asked how deep the groundwater was.

S. Yorgensen said it looks mushy in some spots so groundwater can't be very deep.

J. Csiki asked how deep they will excavate.

J. Vobril said about 9 feet.

K. Metzler asked if Karl had reviewed this.

S. Yorgensen said she and he had both been out there. It appears they will need something more site specific and detailed for the plans.

D. Schreiber noted the area including streams is probably about 300 acres.

The commission discussed the potential amount of excavation.

G. Blessing suggested that test pits be done before they start excavating the area and then find out later it won’t work.

D. Schreiber said the commission will also need information on the elevations, and the projected heights of the banks.

S. Yorgensen said that a review had not been done yet and that a number of things will likely be needed.

G. Blessing asked if the intent was to have the streams discharge into the pond.

J. Vobril said Yes, that would be the natural flow.

G. Blessing said they should check if a diversion permit is necessary.

F. Dirrigl said he would like more information on what type of wildlife is there.

K. Metzler said an ERT report was done on the whole property.

J. Vobril said DEP Fisheries was involved and there is a report on it.

K. Metzler said the commission will wait for a report from Sue & Karl, and in the meantime the test pits should be dug.

S. Yorgensen said they will also need info on the flow and drainage area.


3.     File #W2001-36-Application for a 2-lot subdivision located off of Potter School Road (Map 49, Lot 1A, 31.52 acres). Leo A. Passardi Jr. & Roberta S. Passardi owners/Jeffrey R. Passardi, applicant. (Received on 05/14/01, no decision before 05/28/01, hearing or decision by 07/09/01).

S. Yorgensen reviewed the history of the file.

Mrs Passardi and the commission discussed the Catch 22 whereby Mr. Passardi needs fill to get the sanitation permit required for the wetlands permit, but he needs the wetlands permit before he can do any fill.

J. Passardi said he plans to live in this house and has no intention to move the pond.

S. Yorgensen asked if construction limit lines had been added to the plans.

J. Passardi said Yes.

S. Yorgensen asked about a note on the plans regarding wells within 200 feet.

J. Passardi said there are none. A note has been added regarding S&E controls.

S. Yorgensen asked if there had been discussion about splitting the pond between two owners, as the commission tends to question approval where a pond is co-owned.

The commission discussed problems with dual pond ownership and J. Passardi suggested drawing up an agreement to cover it.

G. Blessing said Karl has reviewed these plans, but Gary has not done a final review because they were just recently submitted.

The commission discussed activity in the wetlands area and reviewed the alternate plans that were proposed.

K. Metzler said it appears the best option would be to move the septic system back as far as possible out of the regulated area. Other commission members still have not seen the site. Since Gary has not done a final review, he suggested an extension be requested.

J. Passardi placed a request for the maximum extension of the dateline for decision.

The commission set a sitewalk for 4 p.m. July 17th.


4.     File #W2001-30-Application for a wetlands permit for a single-family home with driveway within the regulated area located off Jared Sparks Road (Map 32, Lot 10). Steve Amedy, applicant/Basil & Sandra Bocynesky owners. (Received on 04/23/01, no decision before 05/07/01, hearing or decision by 06/25/01, extension requested and approved, decision by 07/23/01).

The commission reviewed the info in the file.

S. Yorgensen noted no new information had been received sine the last meeting.



5.     Travel Centers of America – Request for approval of design for repair to detention/bio-filter.

K. Metzler said he looked at this with Karl. It does not work. It all leaks through.

S. Yorgensen said the elevation and grades need to be done. They are also still waiting for testing results.



The commission discussed issues with the property as follows:

There is a big septic tank out there for no reason.
A tire in the detention pond needs to be taken out.
A maintenance schedule is needed for the oil/water separator
There is much sediment and vegetation is growing in the inlet structure.
A maintenance schedule is needed for the inlet stream.
A 6-foot fence was approved but there is a 4-foot fence there.
Trees on the top of the bank are dead and must be replaced.
Information is needed on the method and sequence of construction for installation of the fabric. The work also needs to be supervised by an engineer or clerk of the works.
Water testing at the inflow and outflow needs to be done.
Elevations need to be shot to assure the bottom of the pond is constructed to allow the flow as designed
.
G. Blessing said they also need to set protocol in order to be sure that testing is done after a significant storm event, because all the data now says “no flow.”


2.     Release of bond for Travel Centers of America

The commission agreed the bond should not yet be released based on the discussion above.

STAFF REPORT & DISCUSSION:


There seems to be discrepancy regarding the truckwash, as TA says the truckwash is not connected to the storm water system, and it is a closed system, but plans do seem to show that it is indeed connected. She reviewed additional problems with the bio-filter area.

G. Blessing asked about the status of the Village Hill Road Bridge.
S. Yorgensen said they are redesigning to put a span over where the fish were. It will cost the town additional monies.


The commission discussed the proposal by the Selectmen to give back the open space parcels on Balazs Road and once the developer subdivided, the Town would get a parcel, sell it, and use the proceeds to buy open space. The consensus of the commission was that there were many problems with that scenario.
D. SCHREIBER MOVED TO ADVISE THE SELECTMEN THAT THE COMMISSION IS STRONGLY OPPOSED.

The commission discussed the Flaherty plans on Old Farms Road. They came in a long time ago for a driveway permit and all other activity was outside of the regulated area. Now they want to ask for a revision to the permit for the existing road, and they want to build with activity in the regulated area. The question is, is it a modification or do they need a new permit. Sue showed the work being done on the plans.
The commission agreed a new permit was needed.
